Exchange of tax information- fishing dutchman's nets stuffed by Swiss Supreme Court

Yesterday, the Swiss Supreme Court overturned a prior instance Federal Administrative Court decision of earlier this year. The Supreme Court allowed a request for bank information from the Dutch tax authorities essentially on grounds of a mere description of a behavioural pattern.

Roman Cincelli

Roman joined Froriep in May 2016 as a trainee lawyer. His principal area of practice is banking and finance law. He graduated in law from the University of Fribourg in 2011. After obtaining his degree, he worked at the University of Fribourg as a research assistant (in contract law, international private law and comparative law) and worked on his PhD thesis in trust law. Roman completed one internship as a law clerk at the Administrative Court of St Gallen in 2015 and another at the District Court of Rorschach in 2016. His working languages are German and English, and he has a good knowledge of French. Roman has not yet been admitted to the Bar.

Benjamin Dürig

Benjamin’s practice focuses on M&A and corporate finance transactions, along with corporate law. Benjamin joined our firm as an associate in 2009 and became counsel in 2017. Before that, he worked at a Zurich district court for a number of years. He was admitted to the Zurich Bar in 2007, and was then employed by a French-speaking law firm in Berne and Biel/Bienne. Benjamin’s law degree is from the University of Zurich (2003), and his working languages are German, French and English. Benjamin is a member of the Swiss Bar Association, the Zurich Bar Association, the Franco-Swiss Chamber for Trade and Industry, and the International Association of Young Lawyers (AIJA).
